Termini e condizioni del servizio
OVERVIEW
Welcome to ASpot. The terms "we", "us" and "our" refer to ASpot Ltd ("ASpot"). ASpot operates this store and website, including all related information, content, features, tools, products and services available through it (the "Services").
ASpot Ltd is a private limited company incorporated in England and Wales under company number 17275536, with its registered office at 53 Sinclair Road, London, W14 0BD, England. Our customer contact email is info@aspot.ch.
These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services or purchase products or services from ASpot.
Please read these Terms of Service carefully before using the Services or placing an order.
By accessing or using the Services, or by placing an order through our website, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use the Services.
Nothing in these Terms affects any statutory rights or protections that cannot legally be excluded or restricted.
SECTION 1 - ACCESS AND ACCOUNT
You must be at least 18 years old to enter into a contract with ASpot, unless you are otherwise legally permitted to enter into a binding contract under applicable law.
Where you create an account or provide information to us, you agree that the information you provide is accurate, current and complete and that you have the right to provide it.
You are responsible for maintaining the security of your account credentials and for activities carried out through your account.
You must not transfer, sell, assign or otherwise make your account available to another person without our prior written consent.
SECTION 2 - OUR PRODUCTS AND SERVICES
We aim to ensure that the information, descriptions, images and specifications displayed on our website are accurate and up to date.
Images are provided for illustrative purposes and may not always represent the exact ticket, seat or experience supplied.
Where a product description specifies a particular ticket category, stand, block, seating area, row, seat, hospitality package or other feature, that information forms part of the description of the product.
Minor variations in appearance, presentation or digital ticket format may occur where these do not materially affect the product supplied.
We may update product information where necessary to reflect changes provided by event organisers, clubs, venues, leagues, broadcasters or authorised ticket suppliers.
We will not make changes to an accepted order in a way that materially reduces your contractual rights without your agreement or unless permitted by applicable law.
SECTION 3 - ORDERS AND CONTRACT FORMATION
When you place an order through our website, you submit an offer to purchase the relevant product or service.
Your order is subject to acceptance by ASpot. A contract between you and ASpot is formed when we send you an order confirmation confirming that your order has been accepted.
We may decline an order before acceptance where there is a genuine reason to do so, including unavailability, pricing or listing errors, suspected fraud, failure of payment, or restrictions imposed by an event organiser, ticket supplier or applicable law.
If we cannot accept your order, we will notify you and refund any payment already taken for that order.
Once an order has been accepted, cancellation and refund rights are governed by these Terms, the applicable product information, our Return & Refund Policy and any mandatory rights you have under applicable law.
You are responsible for reviewing your order before submitting it and for ensuring that the name, email address, contact details and other information provided to us are correct.
Purchases are intended for personal use unless otherwise stated or authorised in writing by ASpot.
SECTION 3A - EVENT TICKETS
ASpot specialises in the sale of event tickets and premium sports experiences through authorised suppliers and commercial partners.
By purchasing a ticket through ASpot, you acknowledge and agree to the following:
3A.1 Ticket Source and Verification
Tickets sold by ASpot are sourced from authorised ticket agents, official clubs, venues, hospitality providers or other authorised commercial partners, as applicable to the relevant event.
Unless expressly stated otherwise, ASpot acts as an independent ticket retailer and is not itself represented as an official agent, partner or representative of the relevant club, league, venue or event organiser.
For HC Ambrì-Piotta, ASpot operates as an authorised partner of the club in connection with the sale of tickets and experiences offered through ASpot.
Where a product is expressly described as being supplied through a particular official or authorised partner, that description applies to the relevant ticket or experience only.
3A.2 Ticket Information and Secondary Ticketing
Where applicable, ASpot will provide the information required by law in relation to the ticket, including the relevant stand, block, area, row, seat or other identifying information, any applicable restrictions on use, and the face value of the ticket where required.
Restrictions may include, for example, home-supporter or away-supporter restrictions, age restrictions, membership requirements, named-ticket requirements, restricted-view conditions or other conditions imposed by the organiser.
Where applicable, the selling price of a ticket may differ from its face value.
Customers should review all ticket-specific information shown on the product page before placing an order.
3A.3 Organiser's Terms and Conditions
All tickets remain subject to the terms, conditions, entry requirements and ground regulations of the relevant event organiser, club, venue, league or other governing body.
By purchasing a ticket, you agree to comply with those rules and requirements.
Where an organiser imposes restrictions that are communicated to ASpot, those restrictions may form part of the conditions applicable to the ticket.
3A.4 Personal Use and Ticket Restrictions
Tickets are intended for personal use unless otherwise expressly authorised.
Customers must comply with any restrictions imposed by the event organiser or ticket issuer concerning use, transfer, resale, naming, membership, identity or admission.
If a ticket is supplied subject to a restriction that has been disclosed before purchase, you are responsible for complying with that restriction.
3A.5 Resale and Transfer
You must not resell, advertise for resale, auction, transfer for commercial gain or otherwise use a ticket contrary to restrictions imposed by the event organiser, ticket issuer or applicable law.
Nothing in these Terms is intended to restrict any right that cannot lawfully be restricted.
Where the organiser permits ticket transfer or resale, that transfer remains subject to the organiser's applicable rules and procedures.
3A.6 Ticket Delivery
Tickets may be delivered electronically or through another authorised delivery method.
Tickets may be supplied as mobile tickets, PDF tickets, digital passes, through an official club or organiser application, or through another authorised ticketing platform, depending on the event.
In many cases, tickets are not released by the organiser or supplier until shortly before the event.
Any delivery estimate shown on the website is an estimate unless the product specifically states that a particular delivery deadline is guaranteed.
We will use reasonable care to deliver your ticket using the method applicable to the relevant event.
If there is a material issue affecting delivery, please contact us promptly using the contact details provided on the website.
3A.7 Event Changes
Match dates, kick-off times, venues, seating allocations and other event details may be changed by leagues, broadcasters, clubs, venues, governing bodies or event organisers.
Such changes may occur after an order has been placed.
Where an event is postponed, rescheduled, relocated or cancelled, any refund, replacement ticket or alternative solution will be handled in accordance with the applicable organiser's policy, the ticket terms and your rights under applicable law.
Nothing in these Terms limits any statutory rights you may have in those circumstances.
3A.8 Seating
Where multiple tickets are purchased together, ASpot will use reasonable efforts to provide seats together where the product description indicates that this is intended.
Adjacent seating is not guaranteed unless expressly stated or confirmed as guaranteed as part of the product purchased.
If a specific seat, block or seating area has been expressly promised as part of the product, ASpot will make reasonable efforts to provide the specified ticket or, where this is not possible, an appropriate alternative or remedy in accordance with applicable law.
3A.9 Admission
Admission to an event is subject to the rules and decisions of the relevant organiser and venue.
A ticket may be refused, cancelled or invalidated where the customer breaches the organiser's conditions, venue regulations, ticket restrictions or applicable law.
ASpot is not responsible for refusal of admission resulting solely from the customer's breach of those requirements.
Nothing in these Terms excludes or limits any responsibility ASpot may have where the refusal results from ASpot's own breach, negligence or other legally actionable conduct.
3A.10 Customer Conduct
Customers are expected to behave responsibly and respectfully at events.
Anti-social behaviour, violence, discrimination, abusive conduct, intoxication or other prohibited behaviour may result in removal from a venue or refusal of admission.
Where a customer is refused admission or removed due to their own conduct or breach of the applicable event rules, ASpot will not normally be responsible for any resulting loss, subject always to applicable law.
3A.11 ASpot's Role and Responsibility
ASpot acts as an independent retailer of event tickets and sports experiences.
ASpot is not responsible for operational decisions made by event organisers, clubs, venues, leagues, broadcasters or governing bodies that are outside ASpot's reasonable control, including postponements, cancellations, fixture changes, venue changes or seating reallocations.
However, nothing in these Terms excludes or limits any liability or responsibility that ASpot cannot lawfully exclude or limit.
SECTION 4 - PRICES AND BILLING
The price payable for a product or service will be the price displayed at checkout before you place your order, subject to any clearly disclosed offer or pricing condition.
Prices may be displayed in different currencies depending on the customer's selected market, location or currency setting, including Swiss francs (CHF), euros (EUR) and pounds sterling (GBP).
For customers in Switzerland, where prices are displayed in CHF, the displayed price is the total price payable, including any mandatory charges or fees. For customers in the European Union or other European markets where prices are displayed in EUR, the displayed EUR price is the total price payable, including any mandatory charges or fees. For UK consumers, displayed prices include VAT where VAT is applicable.
Any mandatory charges or fees payable to complete the purchase will be included in the displayed total. Optional additional products or services will be clearly identified before you are charged.
Prices may vary between products, dates, seating categories, currencies and promotional periods.
If an obvious pricing or listing error occurs, we may contact you before accepting your order. If your order has already been accepted and an error is identified, we will act in accordance with applicable law and your contractual rights.
You agree to provide accurate and complete payment information and to use a payment method that you are authorised to use.
If payment is declined, reversed or otherwise not received, we may suspend delivery or cancel the order to the extent permitted by law.
SECTION 5 - TICKET DELIVERY AND OTHER DELIVERY
Electronic tickets will normally be delivered using the method stated on the relevant product page or order confirmation.
For physical products, where offered, delivery times and charges will be stated before you place your order.
We are not responsible for delays caused solely by circumstances outside our reasonable control, including delays by carriers, ticketing systems, event organisers, clubs or other third-party providers.
However, this does not exclude any rights or remedies you may have where ASpot has failed to perform its own contractual obligations.
SECTION 6 - INTELLECTUAL PROPERTY
All intellectual property rights in the ASpot website, branding, text, graphics, images, designs, logos and other content owned or licensed by ASpot remain the property of ASpot or the relevant rights holder.
You may use the website for personal and lawful purposes only.
You must not reproduce, modify, distribute, publish, commercially exploit or otherwise use ASpot's protected content without prior written permission, except where permitted by law.
Third-party trademarks, club names, logos and event branding remain the property of their respective owners. Their appearance on our website does not by itself imply endorsement or affiliation with ASpot.
SECTION 7 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES
The Services may contain or provide access to tools, applications, payment services, ticketing systems or other functionality supplied by third parties.
Where third-party services are involved, their own terms and policies may also apply.
ASpot is not responsible for the operation of third-party systems to the extent that a failure is outside ASpot's reasonable control.
Nothing in this section limits ASpot's responsibility for obligations that are directly owed by ASpot to you under these Terms or applicable law.
SECTION 8 - THIRD-PARTY LINKS
Our website may contain links to third-party websites, applications or services.
These links are provided for convenience and information. ASpot does not control the content or operation of third-party websites.
If you access a third-party website, that website's own terms and privacy policy may apply.
This section does not affect your rights against ASpot in relation to a purchase made directly from ASpot.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
ASpot is powered by Shopify, which provides the e-commerce platform through which the Services are made available.
Your purchase contract for products or services sold through our store is with ASpot, not Shopify.
Shopify is not responsible for the products or services sold by ASpot or for the performance of any contract between you and ASpot, except to the extent required by applicable law.
This section does not affect any statutory rights you may have.
SECTION 10 - PRIVACY AND PERSONAL DATA
Personal information collected through the Services is processed in accordance with our Privacy Policy.
Our Privacy Policy explains what information we collect, how we use it, the legal bases on which we process it, who we may share it with and the rights available to you.
Because our Services are provided through Shopify and other service providers, personal information may be processed by those providers on our behalf or as required to provide the Services.
Please refer to our Privacy Policy for full details:
https://aspot.ch/policies/privacy-policy
SECTION 11 - CUSTOMER FEEDBACK AND REVIEWS
If you submit a review, comment, testimonial, photograph, suggestion or other feedback to ASpot, you confirm that the content is genuine, accurate and does not infringe the rights of another person.
You must not submit fake, misleading, defamatory, unlawful or fraudulent feedback.
Where you grant ASpot permission to use feedback for marketing or service purposes, you grant ASpot a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish and display that content for those purposes.
This does not transfer ownership of your underlying copyright to ASpot.
ASpot may remove content that is unlawful, misleading, abusive or otherwise breaches these Terms or applicable law.
SECTION 12 - ERRORS, INACCURACIES AND CHANGES
We aim to keep the information on the Services accurate and up to date.
Occasionally, errors or omissions may occur, including in product descriptions, prices, availability or event information.
Where an error is identified before an order is accepted, we may correct the information and, where appropriate, decline the order.
Where an error is identified after an order has been accepted, we will deal with the situation in accordance with applicable law and your contractual rights.
We may update information on the website where necessary to reflect changes from clubs, organisers, leagues, broadcasters, venues or suppliers.
SECTION 13 - PROHIBITED USES
You may use the Services only for lawful purposes.
You must not:
(a) use the Services for fraudulent, unlawful or malicious purposes;
(b) provide false or misleading information;
(c) impersonate another person or entity;
(d) interfere with the operation, security or availability of the Services;
(e) attempt to gain unauthorised access to our systems or another customer's account;
(f) use the Services to distribute malware or other harmful code;
(g) infringe intellectual property, privacy or other legal rights;
(h) use automated systems to access or extract information from the Services in a manner that breaches applicable law or our technical restrictions; or
(i) engage in conduct that could reasonably expose ASpot, Shopify or our users to unlawful harm or liability.
We may suspend or restrict access to an account where reasonably necessary for security, fraud prevention, legal compliance or a material breach of these Terms.
SECTION 14 - AGENTS
14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.
14.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in accordance with the requirements in section 14.4 below. In addition, no Agent may access, use, or interact with any Service if we have requested that the Agent refrain from accessing, using, or interacting with that Service.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with the Services.
14.4 Agents must:
(i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]";
(ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, including by mimicking human behaviour or completing or circumventing CAPTCHAs or other measures intended to distinguish computer use from humans;
(iii) respond truthfully to any question or prompt seeking to determine if interactions are from a human or a computer; and
(iv) not circumvent or otherwise avoid any measure intended to block, limit, modify or control whether and how Agents access, use or interact with the Services.
SECTION 15 - SUSPENSION AND TERMINATION
We may suspend or terminate an account or access to the Services where reasonably necessary because of fraud, unlawful conduct, security concerns or a material breach of these Terms.
Where reasonably practicable, we will provide notice before suspending or terminating access, except where immediate action is reasonably necessary.
Termination or suspension of an account does not affect any rights or obligations that have already accrued under an accepted purchase.
Any provisions that are intended by their nature to survive termination will continue to apply.
SECTION 16 - WARRANTIES AND STATUTORY RIGHTS
We provide the Services with reasonable care and skill as required by applicable law.
Nothing in these Terms excludes, restricts or limits any warranty, condition, guarantee, right or remedy that cannot lawfully be excluded or limited.
You retain all rights and remedies provided by applicable consumer protection law.
We do not guarantee that the website will always be available, uninterrupted or error-free, or that third-party systems will always operate without interruption.
The information on the website is intended to assist you in making informed purchasing decisions, but event information may change where organisers, clubs, leagues, broadcasters or other third parties make changes outside ASpot's reasonable control.
SECTION 17 - LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability for:
(a) death or personal injury caused by negligence;
(b) fraud or fraudulent misrepresentation;
(c) breach of any legal responsibility that cannot lawfully be excluded or limited; or
(d) your statutory rights as a consumer.
Subject to the above, ASpot is not responsible for loss caused solely by an event organiser, venue, club, league, broadcaster, ticketing platform or other third party where that loss is outside ASpot's reasonable control.
ASpot remains responsible for losses caused by its own breach of contract, negligence or other legally actionable conduct, subject to applicable law.
Nothing in this section is intended to exclude or restrict any liability that cannot lawfully be excluded or restricted.
SECTION 18 - CUSTOMER RESPONSIBILITY
You are responsible for complying with these Terms, the applicable event rules and any ticket restrictions communicated to you before purchase.
You may be responsible for losses directly caused by your fraud, deliberate misuse of the Services or material breach of these Terms, to the extent permitted by law.
Nothing in this section requires you to compensate ASpot for liabilities that arise solely from ASpot's own breach, negligence or unlawful conduct.
SECTION 19 - SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed only to the extent necessary, and the remaining provisions will continue to apply.
Nothing in this section affects any mandatory consumer rights or protections.
SECTION 20 - WAIVER AND ENTIRE AGREEMENT
If we do not immediately enforce a provision of these Terms, that does not mean we have waived our right to enforce it later.
These Terms, together with the policies expressly incorporated into them and the information provided to you before purchase, form the agreement between you and ASpot in relation to your use of the Services and your purchase.
Where a specific product description or written confirmation gives you a contractual right that is inconsistent with a general provision of these Terms, the specific product information will prevail to the extent necessary to give effect to the purchase.
Nothing in these Terms excludes information or rights that must legally form part of the contract.
SECTION 21 - ASSIGNMENT
You may not transfer your rights or obligations under these Terms to another person except where permitted by law or with our written consent.
ASpot may transfer its rights or obligations to another company or business as part of a genuine business transfer, provided that doing so does not reduce your legal or contractual rights.
SECTION 22 - GOVERNING LAW AND JURISDICTION
These Terms are governed by the law of England and Wales.
If you are a consumer, you will continue to benefit from any mandatory consumer protections that apply in your country or jurisdiction and that cannot lawfully be excluded by agreement.
Subject to those mandatory rights, the courts of England and Wales will have jurisdiction over disputes arising from or relating to these Terms.
Nothing in this section prevents a consumer from bringing proceedings in another court where mandatory law gives the consumer that right.
SECTION 23 - HEADINGS
The headings used in these Terms are for convenience only and do not affect the interpretation of the provisions.
SECTION 24 - CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, legal requirements or business practices.
The current version will be published on this page with its effective date.
Changes will generally apply prospectively and will not remove rights that you have already acquired under an accepted order unless permitted by law.
Where required by law, we will notify you of material changes.
